OUG no. 53/2017 for the changing and addition of the Employment Code states that the additional deeds to the employment agreements must be prepared before the modification produces effects. This measure is to be appplied starting on Monday, August 7th 2017.

Until now, any modification of a basic element during the execution of the individual employment agreement imposed the conclusion of an additional deed to the employment agreement, in a 20 business days term since the occurrence of the modification. The recent ordnance cancels the 20 business days term, and introduces the obligation of the conclusion of the additional deed and of the recording in the general register of employees recording (REVISAL) before the occurrence of the modification.

The elements that can be the object of changing through an additional deed before the modification comes into act are:

a) the identity of the parties;

b) the workplace or, if the workplace is not fixed, the possibility for the employee to work in different places;

c) the headquarters or, according to each situation, the domicile of the employer;

d) the position/occupation according to the classification of the jobs in Romania or of other legal deeds, as well as the job description specifying the attibutions of the position;

e) the appraisal criteria for the professional activity conduceted by the employee, as applicable by the employer;

f) the risks induced by the job;

g) the date when the employment agreement starts producing effects;

h) for employment agreements for a limited time of for temporary employment agreements, their validity period;

i) the duration of the vacation the employee is entitled for;

j) the conditions of the notice information by any of the contracting parties and its duration;

k) the basic salary, other components of the salary income, and the calendar of the salary payments the employee is entitled for;

l) the mandatory work load, expressed in hours/day and hours/week;

m) the mentioning of the colective employment agreement which regulates the work condition for the employee;

n) the duration of the trial period.
